You are responsible for maintaining the confidentiality of your account and password and restricting access to your account. As such, you agree to accept responsibility for all activities that occur under your account or password.
You agree you will not sell, transfer, license or assign your account, username, or any account rights. You agree that you will not create an account for anyone other than yourself, unless you are a person or a business that is authorized to create accounts on behalf of employers or clients. It is your responsibility to advise us if you are aware of any unauthorized access to your account.
You represent that all information you provide to Myhub upon registration and at all other times will be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy.
You must not create accounts through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
You acknowledge and understand that the Application and Services require and utilize phone service, data access or text messaging capability. Carrier rates for phone, data and text messaging may apply and you are responsible for any such charges.
You must be at least 13 years and over to use the Application. If you are under 18, you may use Myhub only with consent and involvement of a parent or guardian.
You agree that you will not solicit, collect or use the login credentials of other Myhub users.
You are responsible for keeping your password secret and secure.
You must not defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate people or entities and you must not post confidential information via the Application, including, without limitation, your or any other person’s credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.
You may not use the Application for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Application and your Content (defined below), including but not limited to, copyright laws.
You must not change, modify, adapt or alter the Application.
You must not create or submit unwanted email, comments, or other form of commercial or harassing communications to other users of the Application.
You must not use domain names or web URLs in your username.
You must not interfere or disrupt the Application or servers or networks connected to the Application, including transmission of worms, viruses, spyware, malware or any other code of a destructive or disruptive nature.
You must not attempt to restrict another user from using or enjoying the Application.
You agree that you are solely responsible for your interaction with other users of the Application or Services, whether online or offline. Myhub is not responsible or liable for the conduct of any user or person, including any participant in events organized through the Application.
You understand and agree that Myhub cannot and will not be responsible for Content posted using the Application, or any events or meet-ups created or organized using the Application; and that you use the Application at your own risk.
Security and Privacy
If you use the Application to share information, information about your profile on the Application may also be shared and you explicitly consent to share such information.
Your use of any third-party social networking service or application may cause personally identifying information to be publicly disclosed and/or associated with you, even if Myhub has not itself provided such information. You agree that your use of such third-party applications is at your own risk, and you will hold Myhub harmless for activity related to such third-party application.
Myhub uses industry standard security measures related to payments. This includes 256-bit encryption and SSL security. We also do not store any sensitive information on our servers. However, your personal information is stored in our payment partner’s secure vault and then tokenized for future use in association with your account.
Despite Myhub’s security measures, a Host might still take payments for Events and then never hold the Event. Myhub will use its reasonable best efforts to help Guests obtain refunds in situations like this, but cannot guarantee a refund and is not liable for refunds.
You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, “Content”) that you submit, post or display on or via the Application. You represent and warrant that you own the Content posted by you on or through the Application or otherwise have the right to post such Content and that the posting and use of your Content on or through the Application does not violate, misappropriate or infringe on the rights of any third party. In the event Myhub becomes obligated for any royalties, fees, damages and any other monies by reason of Content you post on or through the Application, you agree to pay for all such obligations and indemnify and hold harmless Myhub for any such obligations.
Myhub respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please follow our Notice and Procedure for Making Claims of Copyright Infringement set forth below.
Myhub and other marks, including graphics and logos we use in connection with the Application and Services are trademarks or copyright material of Myhub, LLC and Myhub owns content that is protected by copyright, trademark, patent, trade secret and other laws. Myhub’s trademarks and copyrighted materials may not be used in connection with any product or service that is not Myhub’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Myhub.
Event Payment Terms
Myhub uses a sophisticated payments marketplace designed to facilitate quick and seamless transactions among groups of individuals. Within our marketplace, we’ll take every measure to act in good faith, communicate, and resolve issues alongside our users.
Terms for Organizers (“Hosts”)
Only those users over the age of 18 can organize paid events. Anyone can organize free events.
Hosts may create paid events that require payment for registration. By creating a paid event and providing details regarding the bank account accepting payments for the event, you represent and warrant that you are an authorized representative for such bank account, that all bank account information is true and accurate, and that you will be responsible for all payments, charges and refunds related to the event and the bank account. Myhub is not responsible for any error or omission in the account information you provide. Only U.S. bank accounts can be used. Please see Event Types for more information about the kinds of payments and event structures you can create [link to Types of Events].
Fixed Price. Hosts may create a Fixed price events require payment by Guests in exchange for registration. In such a scenario, Guests are allowed to contribute multiple times to the same event.
Minimum Price. Hosts may create a Minimum priced event where it is optional for Guests to contribute payment in exchange for registration to an event. In such a scenario, Guests are allowed to contribute multiple times to the same event.
Crowd-Funding Goals. Hosts may affix a Financial Goal (the “Goal”) to either a Fixed or Minimum priced event. In such a scenario, the goal is not required in order for the host to be paid. It merely serves as a marketing tool for your event showcasing how much money has been raised at any given time.
Transaction Fees. For paid events, users paying with a debit card will not be charged a fee. Users paying with a credit card will be charged a 3% fee on the total amount.
Verification. Hosts must verify their identity prior to withdrawing funds from an Event. For those users withdrawing large sums of money, Myhub may require additional verification.
Payout. When an event ends or a payout is requested by the Host, provided they have been verified, Myhub will deposit the payout amount requested to the Host’s bank account the next business day.
You are solely responsibility for applicable taxes for all event payments paid to you through Myhub, and for compliance with all applicable labor and employment requirements with respect to your self-employment, sole proprietorship or other form of business organization, and with respect to your employees and contractors. You agree to indemnify, defend and hold Myhub harmless from any liability for, or assessment of, any claims or penalties with respect to such withholding taxes, labor or employment requirements, including any liability for, or assessment of, withholding taxes imposed on Myhub by the relevant taxing authorities with respect to any event payments made to you.
Myhub does not guarantee the success of any event. Hosting an event is at your own risk.
Terms for Participants (“Guests”)
Users must be at least 18 years old to register for a paid event.
In order to register for a paid event, you must provide a valid credit card authorization or verified U.S. bank account. By entering your credit card or bank account information, you represent and warrant that you are an authorized user on the account, the account information is true and accurate, and that you will be responsible for all payments, charges and refunds related to charges for Myhub events. Myhub is not responsible for any error or omission in the account information you provide.
It is solely your choice to participate in an event. You understand registering for and/or paying for an event does not give you any rights in or to that event. Myhub does not guarantee that any event will actually take place. Myhub does not guarantee the use of any payment you make to an event for any purpose. Please see Myhub’s Event Refund Policy for additional terms.
Timing of payments. Your credit card will be charged 30-days prior to your event unless the host requests a payout prior to then. When a host requests a payout, Myhub will uses it's discretion in issuing a payout that host provided they've already met all our verification requirements. If you pay into an event within 30-days of the start date, you'll be charged immediately. Your rights to a refund are described on the Event Refund Policy.
You acknowledge and agree that all payments are between you, the event organizer, and the payment processor only. Myhub is not responsible for any payment transactions, including without limitation any personal or payment information you provide to the payment processor.
If paying with a credit card, you agree to pay Myhub a processing fee of 3% for each event payment.
Payment processing services for users on Myhub are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to [this agreement / these terms / etc.] or continuing to operate as a [account holder term] on [platform name], you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of [platform name] enabling payment processing services through Stripe, you agree to provide [platform name] accurate and complete information about you and your business, and you authorize [platform name] to share it and transaction information related to your use of the payment processing services provided by Stripe.
Hosts may cancel an event at any time using the Application. You, as Host, agree to refund all Guests in full for any Events that you cancel even if you have withdrawn funds from that Event. Failure to refund Guests for canceled Events may result in temporary or permanent termination of privileges on Myhub and may result in further action against the Host.
If an Event is canceled, Myhub will use its reasonable best efforts to provide refunds to Guests but does not guarantee any refunds.
If you cancel an Event, you agree that Myhub may automatically refund all Guests if there are sufficient funds in the Event to cover the refunds. If the Event does not have sufficient funds to cover the refunds (due to early withdrawal by the Host or otherwise), Hosts agree to provide funds to Myhub immediately upon request in order to process refunds.
Guests agree to keep their original payment information on file with Myhub in order to be properly credited for refunds. Myhub is not responsible for bank processing failures due to incorrect information provided by Guests or Hosts.
If a Guest decides to cancel their RSVP for an Event before the Event occurs, the Guest must contact Myhub, and we will use our best efforts to help the Guest obtain a resolution with the Host, which may include a refund. Myhub does not guarantee that the Host will issue a refund, which is solely up to the Host.
No refunds will be issued for canceled RSVPs or no-shows after the Event has occurred.
Myhub will use its reasonable best efforts to obtain refunds for Guests whenever possible, but has no liability for refunds under any circumstances.
Crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols) is strictly prohibited.
Use of the Application or Services is at your sole risk. myhub disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or the material accessible by use of the Application or Services.
MYHUB SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. Myhub DOES NOT WARRANT THAT THE APPLICATION OR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, AND DOES NOT WARRANT THE SECURITY OF INFORMATION TRANSMITTED VIA THE APPLICATION. Myhub WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE APPLICATION OR SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.
YOU AGREE THAT IN THE EVENT YOU INCUR ANY DAMAGES, LOSSES OR INJURIES THAT ARISE OUT OF MYHUB ACTS OR OMISSIONS, THE DAMAGES, IF ANY, CAUSED TO YOU ARE NOT IRREPARABLE OR SUFFICIENT TO ENTITLE YOU TO AN INJUNCTION.
Claims of Copyright Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Myhub's copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Myhub and its affiliates that your copyrighted material has been infringed by us.
Signature of the person authorized to act on behalf of the owner of the copyright interest (electronic or physical);
A description of the copyrighted work that you claim has been infringed upon;
A description of where the material that you claim is infringing is located;
Your address, telephone number, and e-mail address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
